To ensure compliance with Labour Law Regulations, VC Employee Assist provides you with all the required documentation templates. These documents are essential should a CCMA dispute arise.

Compliance

All the below forms will be accessible in your own, private portal once you have signed up with VC Employee Assist.

Attendance Register

A sheet that must be completed and signed daily by the employee. The employer need to co-sign. The signed document must be uploaded on the portal. The Basic Conditions of Employment Act (BCEA) stipulates that employers must record the working hours of all employees in an attendance register.

The CCMA will require this document is the employee was dismissed as result of absenteeism.

The UIF office will require the attendance registers in the event of the employee’s death, and his/her spouse / child wants to institute a claim.

Non-Disclosure Agreement

A non-disclosure agreement (NDA), also known as a confidentiality agreement, is a legal contract between at least two parties that outlines confidential knowledge, or information that the parties wish to share with one another for certain purposes but wish to restrict access to or by a third party.

Application for Employment

Application form to be completed by the potential Employee. This document will contain frequently asked questions and references of employment that will enable the Employer to make an informed decision.

Employee Take on Form

This document will contain all the relevant information to set up the Employee’s payroll portfolio.

Employee Contract

Agreement between the Employee and the Employer stipulate the terms and conditions of employment.

Disciplinary Code

A disciplinary code is a set of rules in South African workplaces that outline expected employee behavior, consequences for misconduct, and procedures for resolving issues.

UIF Registration Form

In South Africa, the UIF (Unemployment Insurance Fund) registration form is required for both Employees and Employers to enroll in the UIF program. It collects information necessary to determine eligibility for unemployment benefits. 2% of the Employee’s monthly salary must be paid over to the UIF on a monthly basis

Workman’s Compensation Fund (COIDA) registration form

In South Africa, the COIDA (Compensation for Occupational Injuries and Diseases Act) registration form is used by employers to register for the program, which provides compensation and medical benefits to employees who experience work-related injuries or diseases.

Resignation of Employee

In the event of the Employee resigning, email payroll@vcemployeeasssist.co.za for the relevant documents.

For UIF and Workman’s Compensation Fund (COIDA) the following documents are needed:

  1. Identification document (ID)
  2. Proof of residence
  3. Copy of banking details

Disciplinary Process

Verbal warning

A verbal warning is a disciplinary measure where an employer speaks to an employee about an issue involving their behaviour, conduct, or job performance. It is usually the very first step of the disciplinary process.

1st written warning

This means that the employee is required to sign the warning to signify that he or she was received it, even if they do not necessarily agree with the warning being issued. A signed warning does not preclude an employee from appealing against it, nor does it invalidate the warning.

2nd written warning

The Employee Second Warning Notice describes the employee’s infraction and informs the employee that failure to make appropriate corrections will lead to further discipline up to and including discharge.

3rd written warning

If an employee fails to improve after receiving one or more written warnings, then the next step is to issue them with a final written warning. As the name suggests, this is the final stage of the disciplinary process before you dismiss the employee and it should only be used as a last resort.

Disciplinary hearing (Notice to attend a hearing)

A disciplinary hearing is a meeting between an employer and an employee when the employer wish to discuss an allegation of gross misconduct with an employee (or any other behaviour that merits disciplinary action).

Dismissal

A dismissal is when a contract of employment between an employer and employee is terminated by the employer. In other words, against the will of the employee.

U-19 (Certificate of Service)

Send an email request for U-19 document (Certificate of Service) to payroll@vcemployeeassist.co.za. It will be mailed to the Employer and Employee.
